Tool Lending Policy

Every member reads and signs this policy before borrowing tools.

Full Policy, Waiver & Indemnification

  1. Members must be age 18 or over to borrow tools from the West Philly Tool Library (“Library”) Inc.
  2. Before borrowing tools, all members must: (a) complete a membership application; (b) be current with membership fees, including any accrued fines; (c) sign the waiver and indemnification form; and (d) sign this tool policy form. Identity verification requires a valid government-issued photo ID and a second form of ID with a current address. All memberships are annual (365 days) and auto-renew to the card on file. Members may opt out of auto-renewal at sign-up, by removing payment info, or by emailing us. Refunds are available if no tools have been borrowed and notice is given within 7 days of payment.
  3. Library staff can help explain how to operate tools. However, by taking possession of any item, the member certifies they are capable of using it safely and properly.
  4. Only the member may use checked-out tools. Lending checked-out tools to others is not permitted unless the Library gives express permission.
  5. Borrowing is generally free. The Library may charge fees for a small number of tools with consumable parts.
  6. All borrowed tools must be returned within seven days. This applies to tools checked out during any open hours, including weekday hours. Tools may only be returned while the Library is open.
  7. Late tools incur a fee of $1 per tool per day the Library is open, capped at the tool’s full replacement cost plus a $50 administrative fee. Tools overdue by more than 30 days may be replaced at the member’s expense (full replacement cost + $50 fee). All fines must be paid before borrowing additional items.
  8. The Library reserves the right to recover overdue tools or unpaid fees by charging the payment method on file, using a collection agency, and/or taking legal action, with associated costs charged to the member. At least two email notices will be sent for overdue tools, plus one notification before charges are assessed. If no response is received within 7 calendar days, charges will proceed and cannot be reversed. Members may not dispute assessed charges with their card issuer. The Library may also ban members based on the severity, frequency, or quantity of unreturned tools, regardless of fines paid.
  9. Power tools and ladders may not be renewed. Other tools may be renewed if the member contacts the Library before the due date and no other member has reserved the tool. The Library may refuse or limit renewals based on demand.
  10. The Library is not responsible for manufacturing defects in any borrowed tools.
  11. If a borrowed tool becomes unsafe or falls into disrepair, the member must immediately stop using it and notify the Library upon return, if not sooner.
  12. All tools must be returned in the same condition they were issued, minus normal wear and tear. Tools must be returned clean and empty (shop vacs, pressure washers, carpet cleaners, etc.). Members agree to pay for loss of or damage to any item and accept the Library’s assessment of condition and restitution, which may equal full replacement cost plus a $50 administrative fee.
  13. The Library reserves the right to refuse any loan at its discretion and to ban any member for any reason, including frequent delinquent or lost tools. Bans may be appealed by mailing a letter to the Board.
  14. By signing, members affirm that all information on their application is current, true, and correct, and that they have read and understand all rules. Failure to comply may result in revocation of borrowing privileges and/or legal action.

Waiver & Indemnification

  1. I am capable of using the tools I am borrowing and will use them in a safe and proper manner.
  2. On behalf of myself and my successors and assigns, I waive any and all claims against the West Philly Tool Library for any injury arising from use of borrowed tools.
  3. On behalf of myself and my successors and assigns, I agree to release, indemnify, and hold harmless the West Philly Tool Library Inc., its officers, agents, volunteers, and employees from any liability, loss, claims, demands, actions, or causes of action for death, injury, or property damage arising from the use or possession of borrowed tools.
